Andrew S. Hicks
I graduated with high honors from the University of Oklahoma, where I studied political science and history. After graduation, I left my home state of Oklahoma to attend The University of Chicago Law School, where I obtained my J.D. I began my practice at Vinson & Elkins LLP, and subsequently was recruited to join King & Spalding LLP. In 2007, I co-founded Schiffer Odom & Hicks PLLC.
My practice includes representing both plaintiffs and defendants in commercial disputes and tort claims in state and federal court and in arbitration. I have handled cases across the United States and abroad, including suits in California, Florida, Hawaii, Illinois, Montana, Oklahoma, Texas, and Panama. I have also represented clients in domestic and international arbitrations involving disputes arising in Louisiana, Texas, Mexico, and the U.K. My cases have included mass tort and products liability claims, breach of contract, class actions, professional negligence claims, business torts, and a variety of other types of disputes.
Texas Monthly magazine recognized me as a "Rising Star" of the Texas legal profession in 2005, 2006, and 2007. I have also been named a "Lawyer on the Fast Track" by H Texas magazine.
While I have represented clients from a variety of industries, my practice has included substantial work in the energy, healthcare, and technology industries. My recent experience includes:
ENERGY INDUSTRY
- The defense of a major oil company in a AAA-administered arbitration related to preferential rights to purchase several oil and gas fields and the sale of several hundred miles of related seismic data. We obtained a take-nothing award for our client.
- Representing a major oil company against personal injury claims asserted by thousands of foreign banana farm workers in cases filed in California, Louisiana, and Hawaii.
- Representing a major oil company against groundwater contamination claims asserted by a number of municipalities and private water purveyors in California.
- Represented an oil-field services company in Texas state court against claims for tortious interference, breach of contract, and fraud.
In addition to representing energy industry clients in litigation and arbitration, I have advised these clients regarding the litigation risks associated with transactions involving preferential rights to purchase, the enforceability of indemnity obligations, and other matters. I have also assisted these clients with the drafting of arbitration clauses.
HEALTHCARE INDUSTRY
- Representing a third-party claims administrator and healthcare cost recovery company in a putative class action in Illinois.
- Representing a physician in a breach of contract action related to the sale of a privately owned hospital.
- Obtained the dismissal of a medical negligence wrongful death action brought against a hospital system.
- Represented healthcare company in a breach of contract and fraud action against an equipment supplier.
I have also represented physicians, hospitals, healthcare companies and their officers in a variety of other actions, including medical malpractice, premises liability, and securities fraud.
TECHNOLOGY & TELECOMMUNICATIONS INDUSTRIES
- Represented a multi-national offshore surveying company in a breach of contract and breach of warranty action against the manufacturer of a defective deep-sea surveying system in an international arbitration administered by the International Centre for Dispute Resolution, the international division of the AAA.
- Successfully represented a manufacturer and operator of automated teller machines in a dispute related to defective switch processing services and software provided by a software manufacturer.
- Represented a publicly traded software manufacturer in a breach of contract and fraud action related to a software design project.
- Represented a radio broadcasting company in a breach of contract action against radio tower and station owner. Obtained injunction to prevent tower and station owner from taking client "off the air" in violation of the parties' agreements.
