Domestic and International Arbitration

We have represented clients in arbitral proceedings across the United States and throughout the world in forums such as the AAA, FINRA, ICC, ICSID, JAMS, LCIA, and UNCITRAL. On the international side, our matters have involved disputes arising in Argentina, China, the Former Soviet Union, India, Mexico, Peru, Trinidad and Tobago and Turkey, and have been decided under the substantive laws of Argentina, England, Mexico, Russia, Trinidad and Turkey, and principles of international law. Our domestic arbitrations concern disputes that have arisen in numerous states that have been decided under the laws of Florida, Louisiana, Nevada, New York, Oklahoma, Washington, Texas, among others.

We have served as lead counsel in important and successful arbitrations involving a wide variety of commercial disputes. Al Odom, Andy Hicks, and Logan Johnson each possess similarly impressive reputations, having represented clients, as both claimants and respondents, in numerous arbitrations involving the energy, construction, healthcare, and telecommunications industries, as well as a variety of others. Our representative matters include the following:

International Arbitration

  • Represented claimant, a multi-national engineering, construction and services company, in a $215 million ICC arbitration concerning the client's construction of an off-shore drilling platform.
  • Represented claimant, a major energy company, in a breach of farm-in agreement arbitration. Obtained a $71 million award in this AAA-International arbitration.
  • Co-counsel for claimant in an ICSID arbitration concerning the loss of an investment in Argentina. Client sought to recover approximately $200 million.
  • Represented claimant in an ICC arbitration related to the breach of a contract involving the distribution of electricity in Turkey. Obtained an award of $28 million.
  • Represented claimant, a multi-national offshore surveying company, in a breach of warranty action against the manufacturer of a deep-sea surveying system in a AAA-International arbitration.
  • Represented respondent in an ICC arbitration related to the construction of a power plant in Peru. Client recovered approximately $10 million on its counterclaim; Claimant recovered nothing.
  • Represented respondent in an ICC arbitration related to the sale of a hazardous waste facility in Mexico. Claimant alleged that client breached environmental representations/warranties and failed to meet contractual EBITDA target.

Domestic Arbitration

  • Represented the claimant, a national managed care organization, in a multi-million dollar breach-of-contract claim before the AAA.
  • Defended a major oil company in a AAA-administered arbitration related to preferential rights to purchase several oil and gas fields and the sale of several hundred miles of related seismic data. We obtained a take-nothing award for our client.
  • Represented the claimant, a national hospital developer, in a $23 million dispute regarding the alleged mismanagement of a hospital. We asserted claims for breach of contract, fraud, and negligent misrepresentation, and obtained a favorable (but confidential) settlement for our client.
  • Represented the respondent in a JAMS arbitration related to an alleged default on a multi-million dollar line of credit.
  • Defended offshore platform engineering firm in a AAA arbitration related to wrongful termination claims of a former executive. We obtained a take-nothing award for our client and recovered our attorneys' fees and costs.
  • Represented the respondent in an architect and engineering malpractice case related to the construction of a hospital in AAA arbitration.
